Why Every Company in Malaysia Needs OSH Compliance in 2025

OSH compliance is no longer just about safety. It is about legal protection, business credibility, and staying competitive.

Whether you are managing a factory, running a corporate office, operating a retail outlet, or leading a school, your company is legally required to comply with Malaysia’s Occupational Safety and Health (OSH) Act.

And if you’re not ready?

You are facing more than just a warning.

Penalties can go up to RM500,000, with potential jail time for responsible persons.

OSH Compliance Is Not Just for Factories

One of the biggest misconceptions is that OSH compliance only applies to high-risk industries like manufacturing and construction.

That is no longer true.

Under Section 1(2) of the OSH Act, any workplace is required to comply. That includes:

  • Offices
  • Retail outlets
  • Cafés and restaurants
  • Schools, colleges, and universities
  • Clinics and hospitals

If you employ people and operate a workplace, you are required by law to comply.

Can You Check These Off Your Compliance List?

Here is what the law expects you to have in place:

  • OSH Policy: Formally documented and communicated (Section 16)
  • Risk Assessment (HIRARC): Conducted and regularly updated (Section 18B)
  • OSH Committee: Required for companies with 40 or more staff (Section 30)
  • OSH Coordinator: Required for companies with 5 or more staff (Section 29A)

This is only the beginning.

Under Section 15(2), employers must also ensure:

  • A safe working environment
  • Proper handling and storage of hazardous materials
  • Employee training and supervision
  • Emergency response planning
  • Safe access routes and escape paths
  • Timely reporting of incidents to DOSH (Section 32)

It is not enough to keep documents on file. You need real systems that are working and maintained.
