Corruption, bribery, cronyism, corrupt practice, improper dealing, abuse of power etc. are common language reported in the news media in the last few years. Efforts in curbing corruption and abuse of power in the public sector is being intensified by the government by improving governance, cultivating integrity with a view to eradicate corruption.

 

This webinar is organised by Malaysia HR Forum, jointly collaborated with EXCEL program, and a program powered by Malaysia Anti-Corruption Academy (MACA).

 

The speaker, Tn Jaya will be covering on Corporate Liability under the Section 17A, MACC Act 2009. The provision under Section 17A of the MACC Act 2009 prescribes the principle of corporate liability whereby a commercial organisation is guilty of an offense if any of its employees and/or associates commit corruption for the benefit of the organisation.

 

Any commercial organisation, together with its “director, controller, officer or partner”; or persons who are “concerned in the management of its affairs”, may be prosecuted if its employees and/or any persons associated with the organisation carry out corrupt practices for the benefit or advantage of the organisation.

 

The need for organisation to establish adequate procedure through organization anti-corruption plan (OACP) is crucial to protect the organization against corruption risk. If a commercial organization is convicted of an offense, the punishment under Section 17A (2) is a fine of not less than 10 times the value of the bribe or RM1 million, whichever is higher, or imprisonment for up to 20 years, or both.
