Overview

EXCEL program is powered by Malaysia Anti-Corruption Academy (MACA) to assist organisations to develop organisation anti-corruption plans (OACP) to reduce the impact of corruption. The provision under Section 17A of the MACC Act 2009 prescribes the principle of corporate liability whereby a commercial organisation is guilty of an offense if any of its employees and/or associates commit corruption for the benefit of the organisation. Any commercial organisation, together with its “director, controller, officer or partner”; or persons who are “concerned in the management of its affairs”, may be prosecuted if its employees and/or any persons associated with the organisation carry out corrupt practices for the benefit or advantage of the organisation.

The need for organisations to establish an adequate procedure through an organisation anti-corruption plan (OACP) is crucial to protect the organization against corruption risk. If a commercial organization is convicted of an offense, the punishment under Section 17A (2) is a fine of not less than 10 times the value of the bribe or RM1 million, whichever is higher, or imprisonment for up to 20 years, or both. Jaya) has been with the Malaysian Anti-Corruption Commission for 9 years. He is an official MACC spokesperson on Section 17A – Corporate Liability, a Certified Integrity Officer (CeIO), and a member of the MACC Transformation Taskforce (2013-2015) as the head of civil society engagement. He is also a regular speaker of the MACC in the area of Anti-Corruption Awareness.He is currently the Deputy Head of Private Sector Engagement at the Community Education Division of Malaysia Anti-Corruption Academy (MACA). He is also an anti-corruption strategist and Integrity management specialist in developing organization anti-corruption strategies for organisations. Tn Jaya holds an MBA (International Business) from Universiti Malaya and BSc. (Hons) Econs. About the Trainer

MOHD HASRAFF HASHIM

A Certified Integrity Officer who has been awarded the Certificate in Compliance by the Basel Institute on Governance, Switzerland, and the Malaysian Institute of Management (“MIM”), he primarily leads his team in providing training, particularly in the Corruption Risk Management (“CRM”) for Certified Integrity Officer (“CeIO”) programme, initiated by the Malaysian Anti-Corruption Academy (“MACA”).

Among the modules and topics included in the CRM programme are section 17A of the MACC Act, National Anti-Corruption Plan (“NACP”), and Organisational Anti-Corruption Plan (“OACP”), and this programme is aimed at various governmental and non-governmental agencies, government-linked companies (“GLCs”), and private companies.

Mohd Hasraff, representing the MACC, has been actively involved in attending international workshops and forums, such as the APEC Workshop to Draft Voluntary Codes of Business Ethics for the Medical Device Sector (Brunei, 2012); Business Ethics Workshop Programme for SMEs (Laos, 2013); and APEC Business Ethics for SMEs Forum (China, 2014). He has also spoken in many integrity and compliance-related forums across Malaysia.
