Many organisations face challenges in managing workplace misconduct, not because the misconduct itself is unclear, but because investigations are poorly conducted and disciplinary documentation is inadequately prepared. An ineffective disciplinary process may expose an organisation to allegations of unfair treatment, procedural unfairness, constructive dismissal, or potential disputes before the Industrial Court. This highly practical one-day programme is designed to equip HR professionals, managers, and employee relations practitioners with the knowledge and practical skills required to manage misconduct cases effectively and fairly. Participants will learn how to identify and assess potential misconduct issues, determine the appropriate investigation approach, and conduct structured workplace investigations in accordance with established principles of fairness and due process. The programme also focuses on gathering, assessing, organising, and documenting relevant evidence to support sound disciplinary decisions. In addition, participants will develop practical skills in drafting clear, precise, and defensible show cause letters that accurately communicate the alleged misconduct and provide employees with a fair opportunity to respond. Through practical examples, case studies, discussions, and drafting exercises, participants will strengthen their ability to manage disciplinary matters professionally, minimise procedural risks, uphold natural justice, and ensure that misconduct investigations and disciplinary documentation are aligned with applicable Malaysian employment laws and sound HR practices.
