This one-day practical workshop provides participants with a working knowledge of how unresolved Industrial Relations (IR) disputes, including dismissal and non-dismissal cases, are managed through the conciliation process at the Industrial Relations Department. Participants will gain an understanding of trade disputes arising from collective agreement negotiations that reach a deadlock, as well as termination or dismissal cases involving performance issues, redundancy, or serious misconduct under Sections 18 and 20 of the Industrial Relations Act 1967. The programme focuses on the practical preparation of prescribed forms, supporting documents, and appropriate mandates for amicable resolution, while equipping participants with strategies to manage key stakeholders, including the IR Officer. Where disputes remain unresolved, participants will also learn how to prepare for referral to the Industrial Court, including organising company witnesses and documentation, establishing a reasonable mandate, and selecting and managing legal representation. Through practical guidance and case-based learning, participants will develop the knowledge and confidence to manage the process from pre-trial preparation and case management through to the trial proper.
